An article published in JAMA Health Forum argues that through the conditions of participation in Medicare and Medicaid, federal agencies like the Centers for Medicare & Medicaid Services (CMS) and the Department of Health and Human Services (HHS) can regulate AI safety in hospitals. The existing mandates in the Medicare and Medicaid Conditions of Participation (CoPs) can be utilized to oversee AI safety in healthcare organizations.

Researchers from the University of Pennsylvania and Duke University School of Medicine suggest that CMS already has the authority to investigate hospitals' patient safety practices related to AI. They emphasize the importance of reporting adverse safety outcomes and errors to ensure patient safety and proper use of AI in healthcare.
